Former White House Counsel C. Boyden Gray published an editorial in the Wall Street Journal on March 7, 2021 arguing that H.R. 1 is an unconstitutional power grab. He writes,
Congress has no power but what the Constitution enumerates. Thus, for congressional elections, Article I, Section 4 gives state legislatures what Justice Neil Gorsuch described as “primary responsibility” to establish the “Times, Places, and Manner of holding Elections for Senators and Representatives,” with Congress holding a secondary power to “make or alter such Regulations, except as to the Places of chusing Senators.” Alexander Hamilton described Congress’s role in its own elections as a “last resort” in the Federalist No. 59.
