WASHINGTON, D.C. — On behalf of the American Free Enterprise Chamber of Commerce, Boyden Gray PLLC, along with co-counsel and former two-time U.S. Attorney General Bill Barr, have filed an amicus brief in support of the American Petroleum Institute’s (API) petition to the Supreme Court of the United States in State of Minnesota v. American Petroleum Institute, et al.
API has petitioned the Supreme Court to hear the case because of the State of Minnesota’s improper efforts to advance a de facto carbon tax on private U.S. petroleum producers. Boyden Gray’s brief argues that there is no jurisdictional impediment to hearing the suits, that the lower court’s ruling relegates defendants with federal defenses to hostile state courts, and that Minnesota’s attempt to tax private energy firms will have enormous geopolitical consequences for energy security.
