Boyden Gray PLLC, along with co-counsel America First Legal Foundation, filed a brief in the Supreme Court of the United States on behalf of U.S. Senator Ted Cruz, Majority Leader Steve Scalise, and 177 other members of Congress explaining why the Colorado Supreme Court erred by concluding that Trump must be excluded from the state’s presidential ballot.

In addition to Senator Cruz and Majority Leader Scalise, the brief was signed by 41 other Senators (including Leader Mitch McConnell) and 136 other Representatives (including Speaker of the House Mike Johnson).

The brief focused on how the Colorado Supreme Court interfered with Congress’s prerogatives under Section 3 of the Fourteenth Amendment, how Section 3 does not apply to someone whose sole oath of office was previously taken as President, and how the decision below lacks neutral principles and will lead to widespread de-balloting of political opponents.
