Boyden Gray & Associates filed a reply brief today on behalf of Aaron and Melissa Klein, the proprietors of Sweet Cakes by Melissa, in a case before the Oregon Court of Appeals raising important questions about free speech and free exercise under the constitutions of the United States and Oregon.
The Oregon Bureau of Labor and Industries fined the Kleins $135,000 after they declined to create art, a custom-designed wedding cake, to facilitate the celebration of a same-sex marriage. The Kleins, who do not dispute in this case the couple’s right to be married, declined to create the cake because of their sincere religious belief that marriage is a sacred union between a man and a woman.
