On February 11, Boyden Gray & Associates joined co-counsel O’Melveny & Myers in filing the Private Appellants’ opening brief in State National Bank of Big Spring v. Lew (D.C. Cir. No. 13-5247). The brief explains why the State National Bank, a century-old West Texas community bank, has “standing” to bring a constitutional challenge against Dodd-Frank’s Consumer Financial Protection Bureau and Financial Stability Oversight Counsel. The Bank’s co-plaintiffs are the Competitive Enterprise Institute and the 60 Plus Association.
On the same day, the eleven State Plaintiffs filed their opening brief, explaining why Dodd-Frank’s express abrogation of creditors’ preexisting statutory rights gives them standing to challenge the constitutionality of Dodd-Frank’s “Orderly Liquidation Authority.”
